Welcome to Romygo. These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity, and Romygo ("we," "us," or "our"), concerning your access to and use of the Romygo.com website, the Romygo mobile application, and any related services (collectively, the "Platform").

By accessing or using the Platform, you agree that you have read, understood, and agreed to be bound by all of these Terms and Conditions in their entirety.

1. The Romygo Service Model

1.1. Technology Intermediary: Romygo operates a technology platform that connects registered users seeking transportation ("Riders") with registered independent contractors providing transportation ("Drivers"). Romygo is strictly a technology provider, not a transportation carrier. We do not own the vehicles, nor do we employ the Drivers.

1.2. Independent Contractors: Drivers operate as independent third parties. Any contract for transportation is strictly between the Rider and the Driver. Romygo is not a party to this contract and simply facilitates the connection and payment processing.

2. App Usage and Intellectual Property

2.1. License Grant: Subject to your compliance with these Terms, Romygo grants you a limited, non-exclusive, non-sublicensable, revocable, and non-transferable license to access and use the Platform on your personal device solely for obtaining or providing rideshare services.

2.2. Prohibited Platform Use: You may not:

  • Remove any copyright, trademark, or other proprietary notices from the Platform.
  • Reproduce, modify, prepare derivative works based upon, distribute, license, lease, sell, resell, transfer, publicly display, or otherwise exploit the Platform.
  • Decompile, reverse engineer, or disassemble the Platform.
  • Link to, mirror, or frame any portion of the Platform.
  • Cause or launch any programs or scripts for the purpose of scraping, indexing, surveying, or otherwise data mining any portion of the Platform.
  • Attempt to gain unauthorized access to or impair any aspect of the Platform or its related systems or networks.

2.3. Network Access and Devices: You are responsible for obtaining the data network access necessary to use the Platform. Your mobile network's data and messaging rates and fees may apply. Romygo does not guarantee that the Platform will function on any particular hardware or devices.

3. Account Registration and Security

3.1. Account Creation: You must be at least 18 years of age to register an account. Registration requires you to submit personal information, including your name, address, mobile phone number, age, and at least one valid payment method.

3.2. Account Integrity: You may only possess one Romygo account. You are responsible for all activity that occurs under your account. You agree to maintain the security and secrecy of your account username and password at all times.

3.3. Identity Verification: You agree that Romygo may verify your identity by asking for government-issued identification or a profile photograph. Failure to provide this may result in denial of access to the Platform.

4. Rideshare Service Terms and Policies

4.1. Passenger and Vehicle Capacity: Riders must respect the maximum seating capacity of the requested vehicle type. Drivers are prohibited by Romanian law from transporting more passengers than the vehicle is legally registered to carry.

4.2. Minors: Riders must be 18 years or older to request a ride. Minors may only ride if accompanied by a parent or legal guardian. Drivers reserve the right to request ID to verify age and may refuse service if this condition is not met.

4.3. Wait Times and No-Shows: Drivers are required to wait a specified number of minutes (indicated in the app) at the pickup location. If the Rider does not arrive within this grace period, the Driver may cancel the ride, and a No-Show Fee will be charged to the Rider's account.

4.4. Luggage and Belongings: Riders are responsible for ensuring their luggage fits within the trunk space of the requested vehicle class. Drivers may refuse the ride if luggage is excessive or poses a safety hazard.

4.5. Pets: Unless a specific "Pet-Friendly" ride option is selected, Riders must obtain the Driver's explicit consent before bringing an animal into the vehicle. This does not apply to certified service animals, which must be accommodated in accordance with Romanian and EU disability access laws.

4.6. Lost Property: Romygo is not responsible for items left in vehicles. We provide an in-app feature to contact the Driver regarding lost items. If the Driver finds the item and returns it, Romygo may facilitate a Return Fee on behalf of the Driver to compensate them for their time and fuel.

4.7. Cleaning and Repair Fees: Riders are responsible for the cost of repair for damage to, or necessary cleaning of, a Driver's vehicle resulting from the Rider's use of the Platform (e.g., food spills, bodily fluids). If a Driver reports the need for cleaning or repair and provides verifiable evidence, Romygo reserves the right to charge the Rider's payment method for a reasonable Cleaning Fee, which is transferred directly to the Driver.

5. Payments, Fares, and Financial Terms

5.1. Dynamic Pricing: Fares may vary depending on current market demand, traffic conditions, and weather. The app will always display the estimated or fixed upfront fare before a ride is confirmed.

5.2. Tolls and Surcharges: The total fare may include applicable tolls (e.g., bridge or highway tolls in Romania), airport surcharges, or municipal fees.

5.3. Payment Authorization: Upon placing a ride request, Romygo may place a temporary authorization hold on your payment method to verify funds. This hold will be released and replaced by the final charge upon completion of the ride.

5.4. Gratuity: Tipping is entirely voluntary. Riders may add a tip through the app after the ride completes. 100% of the tip goes directly to the Driver.

6. Conduct, Safety, and Zero Tolerance Policies

6.1. Mutual Rating System: After every trip, both Riders and Drivers must rate each other and may provide feedback. Consistent low ratings may result in temporary suspension or permanent deactivation from the Platform.

6.2. Zero Tolerance for Intoxicants: Romygo maintains a strict zero-tolerance policy regarding Driver use of alcohol or illegal drugs while operating on the Platform. Riders who suspect a driver is under the influence must end the ride immediately and contact Romygo emergency support and local authorities.

6.3. Weapons Policy: Firearms and explosive weapons of any kind are strictly prohibited in vehicles operating on the Romygo Platform, regardless of whether the user possesses a legal permit.

6.4. Non-Discrimination: Romygo strictly prohibits discrimination against users based on race, religion, national origin, disability, sexual orientation, sex, marital status, gender identity, or age.

7. User-Generated Content

7.1. Feedback and Reviews: Any reviews, comments, or feedback you submit to the Platform remain your property. However, by submitting them, you grant Romygo a worldwide, perpetual, irrevocable, royalty-free license to use, copy, modify, and display such content without further notice or consent.

7.2. Moderation: Romygo reserves the right to remove any user-generated content that violates our community guidelines, contains profanity, or is deemed defamatory.

8. Disclaimers and Limitation of Liability

8.1. Disclaimer of Warranties: The services are provided "as is" and "as available." Romygo disclaims all representations and warranties, express, implied, or statutory, not expressly set out in these terms, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Romygo makes no representation regarding the reliability, quality, safety, or suitability of the Drivers.

8.2. Limitation of Liability: Romygo shall not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost data, personal injury, or property damage related to any use of the services. In no event shall Romygo's total liability to you exceed one thousand Romanian Leu (1,000 RON).

9. Governing Law, Jurisdiction, and Dispute Resolution

9.1. Applicable Law: These Terms and Conditions are governed by and construed in accordance with the laws of Romania, without giving effect to any conflict of law principles.

9.2. Data Protection (GDPR): All personal data processing is conducted in strict compliance with the European Union General Data Protection Regulation (GDPR) and Romanian data protection laws.

9.3. Dispute Resolution: Any dispute, controversy, or claim arising out of or relating to these Terms will first be addressed through mandatory informal negotiation with Romygo Customer Support.

9.4. Jurisdiction: If a dispute cannot be resolved informally, it shall be subject to the exclusive jurisdiction of the competent courts of Bucharest, Romania. Consumer users in Romania also have the right to file complaints directly with the Romanian National Authority for Consumer Protection (Autoritatea Națională pentru Protecția Consumatorilor - ANPC).
